Effective Date
By accessing this website, requesting a proposal, signing an agreement, making a payment, or using any services provided by Kamak Web, you agree to be bound by these Terms & Conditions.
About Kamak Web
Kamak Web is a digital marketing and web development agency providing services including, but not limited to:
- Website Design
- Website Redesign
- Website Maintenance
- Search Engine Optimization (SEO)
- Local SEO
- Google Ads Management
- Social Media Marketing
- YouTube Advertising
- OTT Advertising
- Radio Advertising
- Branding & Digital Consulting
Services may be provided throughout the United States and internationally, subject to applicable laws and restrictions.
Eligibility
Clients must be at least eighteen (18) years of age and legally authorized to enter into a binding agreement.
Clients agree to provide accurate legal name, mailing address, email address, and any information necessary for project execution and contractual obligations.
Restricted Countries & Sanctions
Kamak Web does not provide services to individuals, organizations, businesses, or entities located in countries, regions, or jurisdictions subject to United States sanctions, export controls, or legal restrictions.
We reserve the right to refuse service where legally required.
Official Communication
All official communications, agreements, proposals, invoices, approvals, support requests, revision requests, payment instructions, and project-related matters must be conducted through:
Official Kamak Web social media accounts are listed on our website footer and Contact Us page.
Kamak Web assumes no responsibility for communications, promises, payment requests, instructions, or representations originating from unofficial email addresses, unauthorized social media accounts, messaging applications, or third-party channels.
Payments
Accepted payment methods include:
- ACH Transfer
- Credit Card
- Check
- Cash
All payments are associated with an official invoice issued by Kamak Web.
Payment instructions will only be provided through official communication channels.
Website Design Payment Terms
Unless otherwise agreed in writing:
- 80% deposit is required before project commencement.
- 20% balance is due upon project completion and before final ownership transfer.
- Work may not begin until the required deposit has been received.
Failure to pay outstanding balances may result in delayed delivery, suspension of services, withholding of deliverables, or legal collection efforts.
Payment Delays
Invoices are due according to their stated terms.
A delay of up to three (3) calendar days may be accepted unless otherwise agreed in writing.
Any alternative payment arrangements must be confirmed through official email communication.
Revisions
To ensure efficient project completion, website design projects include:
- One (1) consolidated visual design revision round for each page, including layout, styling, colors, spacing, and appearance.
- One (1) consolidated content revision round for each page, including text, images, videos, and page content.
- One (1) additional content revision following project delivery during the complimentary maintenance period.
Revision requests should be submitted as a consolidated list whenever possible.
The following are not considered revisions and may require additional fees:
- Complete redesigns
- Changes to the approved design direction
- New pages
- New sections not included in the original scope
- Custom functionality
- Third-party integrations
- Additional content creation
- Structural changes to the website
Any revisions beyond the included revision rounds may be billed separately.
Complimentary Maintenance
All website design projects include one (1) month of complimentary maintenance following project delivery.
Maintenance services may include:
- WordPress core updates
- Plugin updates
- Security monitoring
- Website health checks
- Technical troubleshooting
- Performance optimization
- Speed optimization
- Backup verification
- Minor content corrections
- Correction of development-related visual issues
Maintenance is intended to keep the website secure, updated, and functioning properly.
Maintenance does not include:
- Website redesigns
- New page design or development
- New sections
- Custom development
- New features or functionality
- Major layout modifications
- Rebranding projects
- Additional integrations
- Extensive content creation
Services outside the maintenance scope may require a separate quotation and approval.
Monthly Website Maintenance
Monthly maintenance plans are designed to keep websites secure, updated, and functioning properly.
Services may include:
- Core website updates
- Plugin updates
- Security monitoring
- Technical support
- Performance optimization
- Speed improvements
- Backup monitoring
- Minor content updates
Monthly maintenance does not include:
- Complete website redesigns
- New page design or development
- Custom programming
- Major functionality changes
- Additional website sections
- New landing pages
- Extensive content creation
Such services will be quoted separately and approved by the client before work begins.
Visual Defects & Development Errors
Any visual defects, display issues, broken functionality, or development-related errors caused by the original work performed by Kamak Web will be corrected at no additional cost.
This does not apply to modifications made by the client, third-party developers, hosting providers, plugin conflicts introduced after delivery, or changes made after project completion.
Hosting & Domain Services
Unless otherwise agreed in writing, Kamak Web covers domain registration and hosting costs during the first year of service.
Beginning with the second year, all costs associated with domain renewals, hosting renewals, email hosting, SSL certificates, and third-party subscriptions become the responsibility of the client.
Failure to renew these services may result in interruptions beyond Kamak Web’s control.
Ownership & Intellectual Property
Upon full payment of all invoices:
- Ownership of the completed website transfers to the client.
- Ownership of project-specific content created for the client transfers to the client.
Certain agency-owned tools, software licenses, premium plugins, premium themes, templates, frameworks, and subscription-based resources may remain licensed under Kamak Web and may not transfer to the client.
Client Responsibilities
Clients agree to provide all required content, approvals, account access, images, videos, hosting credentials, domain credentials, social media access, advertising platform access, and project information in a timely manner.
Delays caused by the client may impact project timelines.
Project Delays & Abandonment
If a project becomes inactive due to missing client materials, approvals, communication, cooperation, or required access for more than sixty (60) days, Kamak Web reserves the right to place the project on hold or close the project.
Previously paid amounts remain non-refundable.
Outstanding balances remain due.
Digital Marketing Disclaimer
Digital marketing services are provided on a best-effort basis.
While Kamak Web follows industry best practices and continuously works to improve performance, we do not guarantee:
- First-page rankings
- Specific rankings
- Traffic levels
- Leads
- Sales
- Revenue
- Conversions
- Business growth
Search engines, competitors, user behavior, market conditions, and platform policies are outside our direct control.
SEO Disclaimer
Search engines regularly modify algorithms, ranking factors, indexing policies, AI search experiences, and visibility requirements.
No SEO provider can guarantee specific rankings or timelines.
Kamak Web provides professional SEO services intended to improve visibility and performance over time but does not guarantee specific results.
Advertising Services Disclaimer
Advertising performance depends on numerous factors including budget, industry competition, geographic targeting, creative quality, landing page quality, user behavior, and market conditions.
Google Ads, Meta Ads, YouTube Ads, OTT platforms, and other advertising networks may change policies, pricing, or delivery mechanisms at any time.
Results cannot be guaranteed.
Google Ads Billing
Advertising spend is separate from management fees.
Clients may either connect their own payment method directly to advertising platforms or authorize Kamak Web to manage advertising spend on their behalf.
Advertising costs and management fees are separate obligations.
Third-Party Services
Kamak Web is not responsible for failures or disruptions involving hosting providers, domain registrars, email providers, payment processors, advertising platforms, search engines, social networks, or third-party software vendors.
This includes outages, suspensions, policy changes, security incidents, technical failures, or service interruptions beyond our control.
Client Content Responsibility
Clients are solely responsible for the legality, ownership, licensing, accuracy, and rights associated with any content they provide.
This includes logos, images, videos, text, trademarks, products, marketing claims, documents, and other materials.
Post-Delivery Responsibility
Upon final delivery and ownership transfer, clients assume full responsibility for any future modifications, additions, publications, or content posted on the website.
Kamak Web is not responsible for content added by clients or third parties after project completion.
Prohibited Content
Kamak Web reserves the right to refuse or terminate services involving unlawful content including, but not limited to:
- Fraudulent activity
- Copyright infringement
- Illegal drugs
- Illegal gambling
- Hate content
- Illegal adult content
- Sanctioned activities
- Any activity prohibited by applicable law
Portfolio Rights
Unless otherwise agreed in writing, Kamak Web may display completed projects, websites, campaigns, designs, and related work in portfolios, case studies, presentations, marketing materials, and promotional content.
In-Person Training
In-person training and consulting sessions may be available within the Greater Los Angeles area and may be billed separately at the applicable hourly rate.
Limitation of Liability
To the maximum extent permitted by law, Kamak Web’s total liability arising from any claim shall not exceed the amount paid by the client for the specific service giving rise to the claim.
Kamak Web shall not be liable for indirect, incidental, consequential, special, punitive, or lost-profit damages.
Governing Law
These Terms & Conditions shall be governed by the laws of the State of California, United States.
Any disputes shall be subject to the jurisdiction of the courts located in Los Angeles County, California.
